In the PIL filed by
social activist Dr Nutan Thakur
regarding doctor’s strike in Uttar
Pradesh, the Allahabad High Court,
Lucknow Bench showed deep displeasure
over the police action and said that the
judicial commission formed in this
regards shall specially look at this
aspect.
The Bench headed by Chief
Justice Dr Dhananjay Yashwant showed
deep concern about the way the police
has used force in this case. On the
basis of the two You-tube video links
presented by Dr Thakur, the Court said
that prima-facie it seems that the
police has used unwarranted force. The
Court showed concern particularly as
regards the way a Professor and two
medical students were mercilessly beaten
by police. The
Court said that departmental enquiry
shall be initiated against all police
officers found guilty in the enquiry and
they shall be made to compensate the
victims of police atrocity through their
salary.In the morning hearing, the Court
directed the Principal Secretary Home
Anil Kumar Gupta and Principal Secretary
Medical Education B S Bhullar to be
present in Court at 2 PM to apprise
about the situation.
These officers told the
Court that the doctor’s strike is over.
After hearing them, the Court said that
any FIR given by a medical student
against the MLA or policemen shall be
immediately registered. It
said that all these cases shall be
personally supervised by the DGP.The
Court said that it is the common people
who are real suffer of these incidents
and the government shall be very
sensitive about these matters. The
next date of hearing is on 10 March.

की हड़ताल के बारे में सामाजिक कार्यकर्ता
डॉ नूतन ठाकुर द्वारा दायर पीआईएल में आज
इलाहाबाद हाई कोर्ट की लखनऊ बेंच ने पुलिस
द्वारा की गयी कार्यवाही पर गहरी नाराजगी
जताते हुए हड़ताल के सम्बन्ध में गठित
न्यायिक समिति से पुलिस की भूमिका की
विशेष रूप से जांच किये जाने के आदेश
निर्गत किये.
मुख्य न्यायाधीश डॉ धनञ्जय
यशवंत चंद्रचूड की अध्यक्षता वाली बेंच ने
पुलिस द्वारा इस मामले में अकारण बल
प्रयोग को गंभीर बताते हुए उस पर गहरी
आपत्ति प्रकट की. उन्होंने डॉ ठाकुर
द्वारा प्रस्तुत दो यूट्यूब विडियो लिंक
के आधार पर कहा कि इसे देख कर
प्रथमद्रष्टया ऐसा लगता है कि पुलिस ने
बिना वजह बल प्रयोग किया. कोर्ट ने ख़ास कर
एक प्रोफ़ेसर और कुछ छात्रों को पुलिस
द्वारा चारों तरफ से घेर कर मारने की घटना
पर कड़ा ऐतराज़ दर्शाया.कोर्ट ने कहा कि
जांच में जो भी पुलिस अधिकारी दोषी पाया
जाया है, उसके खिलाफ विभागीय कार्यवाही की
जाए. साथ ही पुलिस कार्यवाही में घायल हुए
लोगों को अतिशय बल प्रयोग के लिए दोषी पाए
जाने वाले पुलिसकर्मियों के वेतन से
मुआवजा प्रदान किया जाये.
कोर्ट ने सुबह सुनवाई के
समय यह आदेश दिए कि दो बजे प्रमुख सचिव
गृह अनिल कुमार गुप्ता और प्रमुख सचिव
चिकित्सा शिक्षा बी एस भुल्लर कोर्ट के
सामने उपस्थित हो कर पूरी स्थिति से अवगत
कराएं.कोर्ट में इन अधिकारियों ने बताया
कि डॉक्टरों की हड़ताल ख़त्म हो गयी है.
उनकी बात सुनने के बाद आदेशित किया कि यदि
कोई भी मेडिकल का छात्र सपा विधायक अथवा
पुलिसवालों के खिलाफ एफआइआर दर्ज कराना
चाहता है, उनकी एफआइआर तत्काल दर्ज की
जाए. साथ ही यह भी आदेश दिए कि इस सभी
मुकदमों का पर्यवेक्षण डीजीपी स्वयं
करेंगे. कोर्ट
ने यह कहा कि इस प्रकार कि घटनाओं का
खामियाजा आम जनता को भुगतना पड़ता है और
सरकार को ऐसे सभी मामलों में बहुत
चौंकन्ना रहना चाहिए. अगली सुनवाई 10 मार्च
को नियत की गयी है.
